Opinion | Let Justice in the Gaza War Take Its Course

In seeking the arrests of senior leaders of Israel and Hamas, the prosecutor of the International Criminal Court has given the world a promise of accountability. Anyone demanding an end to the conflict in Gaza and the release of all hostages from the grasp of Hamas should embrace the decision. The prosecutor, Karim Khan, has also brought accusations against Hamas’s Muhammad Deif and Ismail Haniyeh. Mr. Khan is charging Israel’s most senior leadership, including Mr. Netanyahu and Defense Minister Yoav Gallant, for war crimes and crimes against humanity. While Mr. Khan recognized Israel’s “right to take action to defend its population,” he accused them of having “a common plan to use starvation as a weapon of war,” the targeting of civilians and other forms of collective punishment.

The report also did not find that Israel had intentionally obstructed humanitarian aid into Gaza. Such a finding would have triggered a U.S. law barring military aid to countries that block such assistance. They argue that Israel has indiscriminately killed civilians with American arms and intentionally hindered U.S.-supplied humanitarian aid. Either would violate U.S. laws governing arms transfers to foreign militaries, as well as international humanitarian law, which is largely based on the Geneva Conventions. The United States provides Israel with $3.8 billion in annual military aid, and Congress last month approved an additional $14 billion in emergency funding.

President Biden acknowledged on Wednesday that American bombs have been used to kill Palestinian civilians as he warned that the United States would withhold certain weapons if Israel launches a long-threatened assault in southern Gaza. “If they go into Rafah, I’m not supplying the weapons that have been used historically to deal with Rafah, to deal with the cities, that deal with that problem,” Mr. Biden said in an interview with CNN’s Erin Burnett. Mr. Biden had resisted earlier calls to condition aid to Israel. Mr. Biden said he had made it clear to Mr. Netanyahu and his war cabinet that they would not get support if they moved forward with an offensive in densely populated areas. Asked if he hears the message of those young Americans, Mr. Biden said:“Absolutely, I hear the message.”

President Biden acknowledged on Wednesday that American bombs have been used to kill Palestinian civilians as he warned that the United States would withhold certain weapons if Israel launches a long-threatened assault in southern Gaza. In some of his strongest language to date on the seven-month war, Mr. Biden said the United States would still ensure Israel’s security, including the Iron Dome missile defense system and Israel’s “ability to respond to attacks” like the one Iran launched in April. But he said he would block the delivery of weapons that could be fired into densely populated areas of Rafah, where more than a million Palestinians are sheltering. The president had already halted the shipment of 3,500 bombs last week out of concern that they might be used in a major assault on Rafah — the first time since Hamas attacked Israel on Oct. 7 that Mr. Biden has leveraged U.S. arms to try to influence how the war is waged.

Turkey said on Friday that it would suspend all trade with Israel until there was a “permanent cease-fire” in the Gaza Strip, the latest international sanction against Israel and one that underscores the mounting global pressure to end the war in the territory. Turkey’s announcement built on statements the previous day that it had halted all trade with Israel until “uninterrupted and adequate humanitarian aid is allowed into Gaza.” But even as Turkey announced the measures, Israel continued its repeated warnings that it was preparing for an offensive in the southern Gaza city of Rafah that the United Nations said on Friday could result in a “slaughter” in Gaza. In announcing the trade suspension, the Turkish trade minister, Omer Bolat, spoke of Israel’s “uncompromising attitude.” Turkey’s president, Recep Tayyip Erdogan, told a business association on Friday that he anticipated backlash from Western countries but that Turkey had decided to “stand side by side with the persecuted.”

Tel Aviv, Israel CNN —Israel’s war cabinet has been engaged in a heated debate about how and when to respond to Iran’s weekend attack on their country, two Israeli officials familiar with the deliberations tell CNN. In addition to a potential military response, the war cabinet is also mulling diplomatic options to further isolate Iran on the world stage. Benny Gantz, a key member of the war cabinet, has pushed for a swifter response to Iran’s attack, two Israeli officials said. But Israeli officials recognize that will be a difficult needle to thread, hence the ongoing debate. An hours-long war cabinet meeting on Sunday ended without a decision on how Israel will respond to Iran’s attack, an Israeli official said.

Why Iran attacked Israel and what comes next

How did Iran attack Israel? Israel and Iran are long-standing rivals and have been engaged in a shadow war for years. Israel’s war on Hamas, waged since the militant group attacked Israel on October 7, has heightened those tensions. But fears of a spiralling regional war spiked further in early April, when Iran accused Israel of bombing its diplomatic complex in Syria. The “Zionist regime” is a term Iran uses to refer to Israel.

Together we shall win.”Israel will respond to Iran’s attack, but the scope of that attack has yet to be decided, an Israeli official told CNN on Sunday. The official said Israel is yet to determine whether to try and “break all the dishes” or do something more measured. Israel and Iran have long been rivals, but tensions escalated in the wake of Hamas’ attacks on Israel, which left about 1,200 people dead. Iranian ballistic missiles that reached Israel fell on the airbase located in southern Israel, and caused only light structural damage, Israel Defense Forces (IDF) spokesperson Daniel Hagari said. Iran had vowed to retaliate after accusing Israel of bombing its diplomatic complex in Syria earlier this month.

In a conversation with Prime Minister Benjamin Netanyahu late Saturday, Biden sought to frame Israel’s successful interception of the Iranian onslaught as a major victory — with the suggestion that further Israeli response was unnecessary. Biden told the Israeli prime minister in his phone call that he should consider Saturday a win because Iran’s attacks had been largely unsuccessful and demonstrated Israel’s superior military capability, a senior administration official said. Even as American officials stressed to their counterparts that the final decision on how to respond to Iran is up to Israel, Biden has sought to prevent a wider escalation of the conflict. In this handout photo, released early Sunday local time, Israeli Prime Minister Benjamin Netanyahu talks on the phone with US President Joe Biden. “I told him that Israel demonstrated a remarkable capacity to defend against and defeat even unprecedented attacks — sending a clear message to its foes that they cannot effectively threaten the security of Israel,” Biden said in a statement following his conversation with Netanyahu.

Iran has warned that it will respond with “stronger and more resolute” actions if Israel retaliates over this weekend’s strikes, according to Tehran’s ambassador to the United Nations. Biden will also meet with G7 leaders on Sunday “to coordinate a united diplomatic response to Iran’s brazen attack,” according to a statement released by the White House. US defensive assets moved to the region earlier this week and “helped Israel take down nearly all of the incoming drones and missiles,” according to the statement. US forces intercepted more than 70 one-way attack drones and at least 3 ballistic missiles Iran fired toward Israel, according to two US official familiar with the situation. US fighter jets were also part of the US’ response to Iran’s attack on Saturday and shot down drones launched towards Israel, another US official told CNN.

Still, officials from both countries described the meeting as “constructive” in a joint statement and said another, in-person meeting could take place as early as next week. The Israeli delegation included national security adviser Tzachi Hanegbi and minister of strategic affairs Ron Dermer, who chaired the meeting. Pentagon officials shared some of their alternatives for Rafah with Israeli Defense Minister Yoav Gallant when he was in town last week. Netanyahu has said he is undeterred by the Biden administration’s opposition to an invasion of Rafah. Vice President Kamala Harris left the door open last week for unspecified consequences for Israel if it decides to proceed.

Vice President Kamala Harris, who has emerged as one of the leading voices for Palestinians in closed-door meetings, pressed for a pause in fighting in Gaza with a member of Israel’s war cabinet, Benny Gantz, at the White House on Monday afternoon, according to the White House. The vice president emphasized the urgency of securing a hostage deal and reducing the humanitarian crisis that has unfolded alongside Israel’s war against Hamas in response to attacks on Oct. 7. She praised Israel’s “constructive approach” to seeking a six-week cease-fire but urged the government to do more to allow desperately needed humanitarian aid to reach those in need in Gaza. “The vice president expressed her deep concern about the humanitarian conditions in Gaza and the recent horrific tragedy around an aid convoy in northern Gaza,” a White House description of the meeting said. It added that “she urged Israel to take additional measures in cooperation with the United States and international partners to increase the flow of humanitarian assistance into Gaza.”The meeting came as the United States said it would continue airdrops of food that began on Saturday in an effort to confront what humanitarian groups say is a crisis for the more than one million displaced Palestinians in Rafah, in southern Gaza, as Israel prepares to deploy ground forces there.

The United Nations’ top court on Monday was hearing a final day of arguments on the legality of Israel’s decades-long occupation of Palestinian territories, hearings that have added pressure to Israel at a time when attention focuses on the war in Gaza. The hearings, which began last Monday, are the first time that the court, the International Court of Justice, has been asked to give an advisory opinion on the issue, which has been the subject of years of debates and resolutions at the United Nations. The court is likely to take months before issuing an opinion. The representatives, including a team of prominent lawyers, said that Israel has abused Palestinian rights with impunity. The Palestinian Authority’s foreign minister, Riyad al-Maliki, said that Israel had subjected Palestinians to decades of discrimination, leaving them with the choice of “displacement, subjugation or death.”

Opinion | Netanyahu’s Cynical Political Game

It has become clear that Prime Minister Benjamin Netanyahu of Israel is not the leader for this critical moment. But Mr. Netanyahu blocks the way. As a majority of Israelis and their allies can see, Mr. Netanyahu and his insistence on “total victory” over Hamas, with no consideration of the consequences or costs, have become a part of the problem. He is playing a cynical game, using the war to serve his political ends, and Israelis, most of whom support the effort to wipe out Hamas, are getting tired of it. He has even managed to alienate Israel’s most important ally.

New York CNN —Famed economist Larry Summers slammed Harvard’s top leaders on Sunday over concerns about how the Ivy League school is fighting antisemitism. Summers, a former president of Harvard, strongly criticized the selection of Harvard professor Derek Penslar as the co-chair of a newly-formed presidential task force on antisemitism. “I have lost confidence in the determination and ability of the Harvard Corporation and Harvard leadership to maintain Harvard as a place where Jews and Israelis can flourish,” Summers said in a post on X, formerly known as Twitter. The task forces will be charged with examining bias, determining root causes and compiling recommendations to combat hate. “As things currently stand, I am unable to reassure Harvard community members, those we are recruiting or prospective students that Harvard is making progress in countering anti-Semitism,” Summers said.

CNN —The border between Egypt and Gaza “must” be closed, Israeli Prime Minister Benjamin Netanyahu said Saturday – a move that would give Israel complete control over the Palestinian enclave’s access to the world. Egypt has previously warned Israel against military operations in the corridor, according to Egypt’s Ahram Online. Gaza borders Israel on two sides, and its Mediterranean coast and airspace are also under tight Israeli blockades. But aid groups say it is still far from enough and warn of a growing risk of famine for Gaza’s isolated population if Israeli restrictions on imports persist. In three months of siege, more than 23,000 people have been killed in Gaza, according to health authorities in the Hamas-controlled enclave.

What we know about what Israel has found at Al-Shifa

CNN —Gaza’s largest hospital, Al-Shifa, has become a flashpoint in the conflict that began when Hamas militants crossed the border into Israel on October 7, killing around 1,200 people. CNN has not verified the claims of either Israel or Hamas. Israel has repeatedly accused Hamas of operating from tunnels beneath the vast complex of Al-Shifa hospital. The IDF also published an “intelligence-based” illustrated video of what it claims the Hamas headquarters under Al-Shifa looks like. The White House has backed Israel’s claims, saying that Hamas was storing weapons and operating a command node from the Al-Shifa hospital in Gaza, citing US intelligence.

The Israeli military said it is conducting a raid inside Gaza’s biggest hospital Al-Shifa as it targets Hamas militants it claims are operating beneath the structure — which the militant group and hospital officials deny. The United States on Tuesday cited intelligence suggesting Hamas has a command node under the hospital, seeming to back Israel’s assertion. What’s happening on the ground: Khaled Abu Samra, a doctor at the hospital, told CNN they were given 30 minutes’ warning before the Israeli operation on the complex began. Khader Al Za’anoun, a journalist inside the hospital, told CNN that Israeli tanks had moved into the hospital complex, and there were gunfire exchanges across the yard. It’s unclear whether there are IDF soldiers inside the hospital buildings, Al Za’anoun said.

UNITED NATIONS (AP) — China, Iran and a multitude of Arab nations condemned an Israeli minister’s statement that a nuclear bomb on the Gaza Strip was an option in the Israel-Hamas war, calling it a threat to the world. It is widely believed to possess nuclear weapons, and a former employee at its nuclear reactor served 18 years in Israeli prison for leaking details and pictures of Israel’s alleged nuclear arsenal program to a British newspaper in 1986. He urged Israel to stop “such rhetoric or posturing” and join the Nuclear Nonproliferation Treaty as a non-nuclear weapon state. Ambassador Amir Iravani told the conference the nuclear threats directed toward Palestinians by high-ranking Israeli officials highlight Israel’s “pride” in having these weapons in its hands. “The secrecy surrounding Israel’s nuclear capabilities poses a significant threat to regional stability,” he said.

President Biden and his aides have been careful not to even hint in public that Israel could be violating any laws of war. And the State Department continues to approve sales of weapons to Israel while refraining from making any assessments of the legality of Israel’s actions. Israel says it is impossible to defeat its enemy without killing innocents — a lesson that Americans and their allies should understand. Mr. Netanyahu added that the attack “was a legitimate act of war with tragic consequences that accompany such legitimate action. And during Secretary of State Antony J. Blinken’s visits to Israel after the Oct. 7 Hamas attacks, Israeli officials privately invoked the 1945 U.S. atomic bombings of Hiroshima and Nagasaki.
