Missouri is set Tuesday to execute Marcellus Williams, a death row inmate whose case has spurred several efforts to save his life amid doubts about the evidence presented at his 2001 murder trial and the actions of a trial lawyer in the case. The attorneys are asking for the court to either find that those actions violated Williams’ rights or have a lower court address those issues. A St. Louis County circuit judge and Gayle’s family also agreed to the deal, but state Attorney General Andrew Bailey, a Republican, opposed it, and the state Supreme Court agreed. A judge ultimately rejected the motion to vacate, a ruling Williams’ attorneys appealed to the state Supreme Court in the hearing Monday. In addition to the state Supreme Court appeal, Williams’ attorneys also have an appeal before the U.S. Supreme Court and a clemency request before Missouri Gov.

On June 4, the Missouri Supreme Court set a September execution date for a man named Marcellus Williams. Williams is most likely innocent of the charges against him. On Aug. 11, 1998, a 42-year-old former Saint Louis Post-Dispatch reporter named Felicia Anne Gayle was found stabbed to death in her home. She’d been stabbed 43 times; her husband found her with the knife still in her neck. Despite the media coverage and the intense interest in the case, the murder went unsolved for 15 months, until the police charged Williams with the crime.

Gayle, a social worker and one-time St. Louis Post-Dispatch reporter, was killed at her home in 1998. Williams’ girlfriend asked him why he would wear a jacket on such a hot day. They cited testimony from Henry Cole, who shared a St. Louis cell with Williams in 1999 while Williams was jailed on unrelated charges. Last February, a St. Louis judge overturned the conviction of Lamar Johnson, who spent nearly 28 years in prison for a killing he always said he didn't commit.
