Washington CNN —Jury selection is set to begin Thursday in a closely watched defamation trial pitting voting technology company Smartmatic against the right-wing cable network Newsmax, in a high-stakes case over the airing of false 2020 election claims. The Newsmax case revolves around the same false claims, championed by former President Donald Trump and his Republican allies, that the 2020 election was rigged by Smartmatic software and others. The Florida-based company sued Newsmax and other right-wing outlets and figures in 2021, alleging that its reputation was destroyed by the lies. The Newsmax case will test the legal limits of publishing lies about the 2020 election, and the trial will play out during the final stretch of the 2024 campaign. ‘Dozens’ of defamatory reportsAfter mainstream news outlets – and even Fox News – projected that Democratic nominee Joe Biden would win the 2020 election, Trump and his surrogates falsely claimed that he won.

Remember I used to say: ‘Don’t do it, but if you do it, keep the oil.’”Facts First: Trump’s claim that he said “Don’t do it” is false; the claim was debunked eight years ago. In reality, Trump did not publicly express opposition to the March 2003 invasion of Iraq before it occurred. In his 2000 book, “The America We Deserve,” Trump argued a military strike on Iraq might be necessary; when radio host Howard Stern asked Trump in September 2002 whether he is “for invading Iraq,” Trump responded, “Yeah, I guess so. Trump claimed on Fox, as he has before, that Iran “called me” to let him know of its plan to deliberately miss. Trump has provided no substantiation for the claim that Iran called him to telegraph the strike and offer reassurance.

CNN —Trump allies Michael Flynn and Steve Bannon have been subpoenaed by Smartmatic as part of the voting technology company’s massive defamation lawsuits against Fox News and Newsmax over their promotion of 2020 election lies. Court filings made public last week in New York and Delaware indicate that Flynn and Bannon were hit with subpoenas, demanding that they sit for depositions and answer questions under oath. Fox News and Newsmax deny wrongdoing and are fighting the lawsuits. Both Flynn and Bannon played a key role in Trump’s attempts to overturn his 2020 election defeat. Bannon was federally indicted in a fraud scheme in 2020, through Trump pardoned him before trial.

The researcher, Nina Jankowicz, briefly served in the Biden administration as head of the now-defunct Disinformation Governance Board, which was housed in the Department of Homeland Security. The lawsuit is the latest in a series of high-profile defamation cases brought against Fox News in recent years. The network last month settled a lawsuit filed by Dominion Voting Systems for $787.5 million, the largest publicly known settlement in US history. Smartmatic’s case survived a motion to dismiss filed by Fox News last year and continues to move through the court system. Lachlan Murdoch, the chief executive of Fox Corporation, the parent company of the right-wing channel Fox News, said on Tuesday that the company will fight Smartmatic’s lawsuit.
This is very serious,” Delaware Superior Court Judge Eric Davis said Wednesday at a pretrial hearing in Wilmington. The special master will look into what sanctions might be appropriate against Fox, including potentially instructing jurors in the case that Fox inappropriately blocked Dominion from obtaining key evidence. The judge ordered Fox to preserve “any and all communications” related to the Murdoch issue. Fox denies wrongdoing and says it properly disclosed Murdoch’s roles in its public financial filings. Fox attorney Dan Webb said Wednesday that “nobody intentionally withheld information” from Dominion.
