Fashion brands' legal claims are varied but ultimately boil down to concerns that third parties are free-riding on brands’ valuable IP in ways that could risk confusing consumers, eroding primary sales and tarnishing or diluting carefully cultivated marks. Some big brands, like Prada, Gucci and indeed Levi’s, have already dabbled with upcycling collections and programs of their own. These days, she says she’s having about a conversation a week with brands interested in exploring collaboration, but the industry moves slowly.

(CNN) — It’s so hard to get your hands on an Hermès Birkin bag that it should be illegal. Hermès’ ultra-exclusive positioning has meant Birkin sales have continued to overperform in the market even as most other luxury brands see demand slowing from post-pandemic highs. A scarcity-driven distribution model has helped drive desire for Birkins, as well as more broadly fuel Hermès’ business. ‘It’s almost seen as a hack’These tactics are all part of the industry’s hope to neutralize the booming counterfeit market, with some estimates asserting that fake fashion and luxury items account for 60% or more of the multi-trillion-dollar trade in fake goods. Sympathy for brands “can be hard for consumers in general, particularly those who are deeply steeped in TikTok culture,” Scafidi said. According to Business of Fashion, the average price for a women’s designer handbag in the US spiked 27% from 2019 to 2022. Last year saw record-breaking profits for the luxury sector, with around 95% of brands seeing growth, according to an estimate by consulting firm Bain & Company. “Right now, vintage is on trend, and we actually see new replicas of vintage items — items that were made in the ’80s or ’90s,” Thompson said.

TikTok is hiring staffers to sell pre-owned luxury items like bags and collectibles like sneakers. Its investment in pre-owned goods shows how far the company's "everything store" ambitions extend. It's hiring a "Head of Pre-Owned Luxury" operation lead in Seattle to develop a go-to-market strategy and build a team of sellers focused on pre-owned luxury items. TikTok's plan to invest more in pre-owned luxury sales arrives as some TikTok Shop merchants have already been testing selling pre-owned luxury goods like jewelry, watches, and Chanel handbags, The Fashion Law reported. The market for pre-owned luxury items has exploded in China in the last few years, including on Douyin.

☆ Patagonia accuses Nordstrom of selling 'thousands' of fake Patagonia sweatshirts and T-shirts at its Rack stores

Patagonia filed a lawsuit against Nordstrom in California federal court on Tuesday accusing the retailer of selling 'counterfeit' Patagonia products. Patagonia had a "years-long dealer relationship" with Nordstrom, but after Patagonia chose to end the agreement Nordstrom sold "counterfeit" Patagonia items in its off-price Nordstrom Rack stores in 2023, according to the suit filed Tuesday in the US District Court for the Central District of California. An alleged counterfeit Patagonia clothing item claiming to be both 100% polyester and made of organic cotton. Additionally, Patagonia is asking a judge to immediately prevent Nordstrom from manufacturing, producing, sourcing, importing, and selling any products that resemble Patagonia's products and trademark.

New York CNN Business —Earlier this week Adidas ended its partnership with rapper and fashion designer Ye (who previously went by Kanye West). He even called out Adidas directly during a podcast appearance in which he made antisemitic comments, bragging the company would never cut ties with him. He referenced Adidas directly: “I can say antisemitic things, and Adidas can’t drop me,” he said. Adidas said it will take a big loss in the fourth quarter because its cutting ties with Ye.

While the Adidas statement definitively closes the door on selling Yeezy branded products, according to legal experts I talked with, it opens the door for them to rebrand the existing Yeezy designs sans Ye. Haff told me that the “sole owner” sentence in Adidas statement is a legal “warning shot” to Ye. Could Ye now build out his own Yeezy fashion brand? Adidas’ Yeezy sneakers were some of the most coveted and influential shoes, often selling for thousands of dollars on the resale market. Last month, Cowen analyst John Kernan estimated that the Yeezy brand accounts for 4 to 8% of Adidas’ overall revenues.

HermèsHermès was hit with a proposed class-action antitrust lawsuit on Tuesday over what litigants allege is an illegal requirement for Birkin hopefuls to purchase ancillary products from the brand. Susan Scafidi, the director at Fordham University's Fashion Law Institute, told BI it would be difficult for plaintiffs to prove that Hermès' has a "lockstep policy" on how much a customer should purchase to access a Birkin or how sales associates determine who gets a bag. Melissa K. Dagodag, an attorney specializing in business law, also told BI that the lawsuit would be difficult to prove. "Maybe Birkin bags will become less of a status symbol and more of an 'I'm a sucker' symbol, casting buyers in some kind of unintended dark light," Dagodag told BI. "In other words, there may never be a better time for an ordinary customer with thousands to spend on a bag to go shopping," Scafidi told BI.
