The indictment noted a search of Menendez's home in 2022 turned up "two one-kilogram gold bars and nine one-ounce gold bars that had serial numbers indicating they had previously been possessed" by Daibes. For the third time in six months, Senator Robert Menendez stood before a judge in Manhattan on Monday to be arraigned on new criminal charges filed as part of an expansive federal bribery investigation. The New Jersey Democrat will make his first appearance in a federal court in Manhattan amid growing calls from colleagues that he resign from Congress. It's the second corruption case in a decade against Menendez, whose last trial involving different allegations ended with jurors failing to reach a verdict in 2017. An attorney for Nadine Menendez has said she also denies the allegations and will fight the charges. Prosecutors say Hana promised to put Menendez's wife on his company's payroll in a low-or-no-show job in exchange for Menendez using his influential post to facilitate foreign military sales and financing to Egypt. In one case, he pushed to install a federal prosecutor in New Jersey whom Menendez believed he could influence to derail a criminal case against Daibes, prosecutors allege.

The senator, Ms. Menendez, Mr. Hana and two other businessmen were each charged with conspiracy to commit bribery and conspiracy to commit honest services wire fraud. Mr. Menendez and his wife were also charged with conspiracy to commit extortion under the color of official right, meaning that they used the senator’s official position to force someone to give them something of value. Mr. Menendez has maintained his innocence, saying Friday that prosecutors “wrote these charges as they wanted; the facts are not as presented.” At a news conference on Monday, he said he had no intention of bowing to calls for his resignation. Mr. Menendez, his wife and the two other businessmen — Fred Daibes, a New Jersey real estate developer and fund-raiser for Mr. Menendez; and Jose Uribe, who works in trucking and insurance — are expected to be arraigned in Federal District Court on Wednesday morning.
