The National Security Agency collected the intelligence that gave US officials insights into China and Iran’s capabilities in producing deepfakes, one of the sources said. At a briefing last week, FBI officials warned that AI increases the ability of foreign states to spread election disinformation. US officials have maintained a high level of visibility into the AI and deepfake advancements made by countries including China, Iran and Russia since the 2020 election. Nearly 70% of Republicans and Republican-leaners said that President Joe Biden’s 2020 election win was not legitimate, according to a CNN poll released in August. CNN —The US Justice Department on Tuesday notified Boeing that it breached terms of its 2021 agreement in which the company avoided criminal charges for two fatal 737 Max crashes. The notification comes as the Justice Department conducts a new investigation into Boeing’s operations in the wake the door plug incident. The earlier deal had resolved a fraud investigation related to the company’s development of its 737 Max aircraft. Under its deferred prosecution agreement from January 2021, Boeing paid $2.5 billion in penalties and promised to improve its safety and compliance protocols. In March, the FAA identified more potential safety issues with the engines of the 737 Max and 787 Dreamliner.

CNN —The ship crash that destroyed Baltimore’s Francis Scott Key Bridge and left several people dead is now under federal criminal investigation, according to a US official familiar with the matter. The FBI and the US Coast Guard are leading the criminal investigation into the disaster and whether the crew failed to report an earlier issue with the vessel that delayed its departure, the official said. The bridge collapsed around 1:30 a.m. March 26 after a massive cargo ship called the Dali lost power and struck the bridge. The National Transportation Safety Board has been investigating why the 213-million-pound ship lost power and crashed into the 47-year-old bridge. The US Army Corps of Engineers has said it plans to reopen the channel affected by the crash by the end of May.

US government agencies are already banned from using Kaspersky Lab software but action to prevent private companies from using the software would be unprecedented. It’s the latest US government effort to use its vast regulatory powers to prevent Americans from using popular technology that US officials consider a national security risk. A Kaspersky Lab spokesperson did not respond to questions about a potential prohibition or about how big the company’s market share is in the US. Commerce Department officials have to carefully consider how practical any such regulation would be for the department to enforce and for users to comply with. But the expected move from the Biden administration would go a step further by using Commerce Department authorities to prevent private companies from using Kaspersky Lab software.

Manafort, who was one of several individuals who ran Trump’s 2016 presidential campaign, was pardoned by Trump after being found guilty of several financial crimes in 2018. Trump has told allies he wanted to bring Manafort back into the fold, but it was unclear in what capacity. The former Trump campaign staffer was found to have committed financial fraud in 2019. which found evidence Biden willfully retained classified materials but that the evidence did not rise to the level of proof beyond a reasonable doubt. And he took on criticism directly over his inclusion of the state of Biden’s memory. On the Republican side, lawmakers pressed Hur on why he didn’t charge Biden despite the evidence of classified documents in Biden’s possession. “In short, to borrow a phrase from the last administration, the Hur report represents the complete and total exoneration of President Biden,” Nadler said. Hur found some evidence that Biden willfully retained classified materials after he left the Obama White House.

In the 388-page report released last month, Hur concluded that Biden mishandled and improperly disclosed classified information after leaving the vice-presidency. But Hur said that he didn’t believe there was enough evidence to charge Biden with a crime. According to the transcript, Biden asks aloud when he was vice president, as he tried to recall timelines. “Remember, in this time frame, my son is either deployed or is dying,” Biden said, according to the transcript. The transcript shows investigators at times seeming to struggle to keep control, as Biden used up time with long answers.

CNN —Commercial fishermen off the coast of Alaska have found what officials are concerned could be another spy balloon and are bringing it to shore with them, three sources familiar with the matter told CNN. The existence of high-altitude surveillance balloons burst into US consciousness last year, when a Chinese spy balloon appeared to blow off course and transited across the continental US. The US assessed that the spy balloon was part of an extensive surveillance program run by the Chinese military, as CNN reported at the time. There were three additional shootdowns of unidentified high-altitude objects in the weeks following the Chinese balloon incident. NORAD later said in a statement that the balloon was “likely a hobby balloon” that posed no threat.

CNN —Special counsel David Weiss charged a former FBI informant with lying about President Joe Biden and his son Hunter Biden’s involvement in business dealings with Ukrainian energy company Burisma Holdings. Alexander Smirnov, 43, is facing charges in connection with lying to the FBI and creating false records. CNN is working to determine whether Smirnov has an attorney. Smirnov’s charge undercuts a major aspect of Republicans’ claims that Joe Biden was financially benefiting from his son’s business dealings in Ukraine. According to court records, Smirnov told an FBI agent that he had spoken with the owner of Burisma about the company’s efforts to buy a company in the United States.

White House and Biden allies have taken aim at Hur for what they view as a gratuitous characterization of the president. White House Counsel Ed Siskel and Robert Bauer, the president’s personal attorney, were in the White House Map Room for the president’s interview with Hur, people briefed on the matter said. It was a mistake for the White House to “put him out on weakness and not strength,” one administration official said. White House officials stood by the forcefulness of the White House’s pushback to Hur’s report, saying not only did Biden take questions from reporters Thursday night, but the next day, White House counsel spokesman Ian Sams joined the press briefing. The White House has also sent a letter to the White House Correspondents’ Association taking issue with news coverage of the Hur report, the officials pointed out, while the Biden campaign has pointed to allies and legal experts questioning aspects of the report that the White House sees as problematic.

Carolyn Kaster/AP/FileUS national security officials have to weigh whether publicly calling attention to disinformation might inadvertently amplify the very message they’re trying to bat down. In both scenarios, federal officials favored a muted public response, largely choosing to let state and local governments take the lead. State and local officials run elections and are more trusted voices in their communities, but how can federal officials act decisively to support them? “It’s a trick box,” said Adam Hickey, who worked on election security issues for the Justice Department’s National Security Division. “[W]e prioritize tabletop exercises that integrate the range of cyber, physical, and operational threats election officials may encounter,” Conley said in a statement to CNN.

Washington CNN —Special counsel Robert Hur released a searing report Thursday that concluded President Joe Biden willfully retained and disclosed classified military and national security information but recommended he not face charges after a yearlong investigation into his handling of classified documents. The special counsel report found that Biden willfully retained classified information, including top secret documents, and knew he was in possession of some documents as far back as 2017. House Oversight Committee Republicans, who have separately investigated Biden’s handling of classified documents, criticized Hur’s report before it was even released or delivered to Congress. “Most notably, after being given multiple chances to return classified documents and avoid prosecution, Mr. Trump allegedly did the opposite.” Hur wrote. “Among the places Mr. Biden’s lawyers found classified documents in the garage was a damaged, opened box containing numerous hanging folders, file folders, and binders,” the report said. CNN —FBI Director Christopher Wray on Wednesday warned that Chinese hackers are preparing to “wreak havoc and cause real-world harm” to the US. Chinese government-backed hackers, Wray said, are targeting things like water treatment plants, electrical infrastructure and oil and natural gas pipelines, Wray said. The Chinese hackers are working “to find and prepare to destroy or degrade the civilian critical infrastructure that keeps us safe and prosperous,” Wray said. The hearing comes in the wake of a big push by US and Chinese officials to ease tensions in the relationship between the two superpowers. The court order allows the Justice Department to update vulnerable software used by thousands of devices in the US that are vulnerable to the Chinese hacking, the source said. The Justice Department action is an effort to undercut the Chinese hackers’ ability to communicate with some of the infrastructure used in the hacks. The Justice Department and FBI declined to comment. Rob Joyce, a senior National Security Agency official, has told CNN that the Chinese activity is “unacceptable” because of its potential disruptive effects. “I think the difference here is how brazen it is in scope and scale,” Joyce told CNN last May.

Garland said he agrees with special counsel Jack Smith’s assertion that the “public interest requires a speedy trial” in the 2020 election currently set for trial in March in Washington, DC. “The matter is now in the hands of the trial judge to determine when a trial will take place,” Garland said during the interview taped Thursday. And it’s is now in the hands of the judicial system, not in our hands,” Garland said. It’s unclear if that case – or the three other criminal cases pending against the former president and GOP presidential front-runner – will go to trial before the 2024 election. Garland also defended his use of special counsels to lead several investigations into Trump, President Joe Biden, and Biden’s son, Hunter, arguing that regulations keep investigators independent.
