AdvertisementAdvertisement"Part of the problem is that the witness has what I'll simply call an interesting way of responding to questions," Kaplan said during the hearing. AdvertisementAdvertisementWhen Sassoon asked Bankman-Fried directly if he discussed spending FTX customer deposits with his lawyers, he took a long pause and looked down before he answered the question. Sassoon, questioning Bankman-Fried on the witness stand, asked Bankman-Fried to be more explicit about why he thought that explanation was acceptable. Asked directly by Sassoon if it was OK to steal customer funds, Bankman-Fried rejected that interpretation of events. Sassoon made that clear on Thursday as Kaplan asked for a broad timeline of the rest of the trial.

The plaintiffs' lawyer who filed that case, Kerry Miller of Fishman Haygood, told me on Wednesday that he plans to monitor the Bankman-Fried criminal case for any Fenwick & West documents that might boost the class allegations. Companies are typically reluctant to waive privilege for fear that their lawyers’ documents might be used in other cases. That assertion seems to hint that Bankman-Fried will claim that he can personally waive privilege over some Fenwick & West communications. The strongest defense case, Sandick said, would probably feature testimony from a Fenwick & West witness to bolster testimony from Bankman-Fried about his reliance on advice from FTX lawyers. But contradictory testimony from a law firm witness could undermine Bankman-Fried’s advice-of-counsel defense.

REUTERS/Jane RosenbergMay 2 (Reuters) - A friend of E. Jean Carroll on Tuesday backed up the writer’s account of being raped by Donald Trump, testifying during a civil trial that she received a phone call about the alleged attack minutes after it occurred. Birnbach, author of many books including "The Official Preppy Handbook,” said Carroll told her Trump slammed her into the wall, pulled down her tights and “penetrated her with his penis.”“I whispered, E. Jean, he raped you. Carroll told jurors last week that Trump put his fingers into her vagina, which she called "extremely painful," and then inserted his penis. Birnbach testified that Carroll refused to go to the police after the alleged rape and asked her to never tell anyone about the incident. NEW YORK, May 1 (Reuters) - E. Jean Carroll returned to the witness stand in her rape and defamation civil case against Donald Trump, after the judge denied a defense request for a mistrial. Trump's lawyer Joe Tacopina began cross-examining Carroll for a second day, hoping to show jurors inconsistencies or holes in her claims against the former U.S. president. In seeking a mistrial, Tacopina wrote an 18-page letter early on Monday accusing U.S. District Judge Lewis Kaplan of bias against Trump. Trump's lawyer also challenged Kaplan's statement that Trump might be "sailing in harm's way" after his son Eric Trump discussed on Twitter how LinkedIn co-founder Reid Hoffman was helping fund Carroll's case. TRUMP NOT ATTENDING TRIALA businessman-turned-politician, Trump has not attended Carroll's trial, and on Monday was in Scotland for a short trip to visit his golf courses there and eventually in Ireland.
