As many as 300 people, most of them Black, were killed when white residents burned Tulsa's African American neighborhood of Greenwood. An Oklahoma judge dismissed the lawsuit in July and their lawyers have appealed to the state's supreme court. White residents surrounded the courthouse, demanding the man be handed over.

The legal fight over reparations for the 1921 massacre of Black residents in Tulsa, Okla., will continue, after the Oklahoma Supreme Court agreed to hear an appeal of a lower court’s dismissal of a lawsuit filed by the attack’s last three living survivors. The lawsuit, filed in 2020, includes the city, the Tulsa County sheriff, county commissioners and the Oklahoma Military Department, which administers the Oklahoma Army and Air National Guard, as defendants. A Tulsa County district judge dismissed it in July, and the state’s high court agreed last week to hear an appeal. “It is a huge victory for us,” Damario Solomon-Simmons, a lawyer for the plaintiffs, said in an interview on Tuesday. Ms. Benningfield Randle said she still has flashbacks of corpses being stacked on the street as her neighborhood burned, according to the lawsuit.

More than 100 massacre survivors and their descendants filed a federal civil rights lawsuit against the City of Tulsa, the State of Oklahoma and others. A federal judge ultimately agreed, citing the lawsuits filed by Mr. Franklin and others as evidence that Greenwood residents had already had their shot at restitution. The duty of deciding whether to approve any kind of reparations package will fall to the California Legislature. In Tulsa, Judge Wall recommended that the Greenwood survivors follow a similar route, pursuing justice through the legislative or executive branches. But Oklahoma lawmakers have declined to support reparations bills advocated by state legislators in the past.
