The criminal trial of Donald Trump didn’t have to end this way. If Mr. Trump’s lawyers had played their cards right, they most likely would have ended up with a hung jury or a misdemeanor conviction. The defense lost a winnable case by adopting an ill-advised strategy that was right out of Mr. Trump’s playbook. I have practiced criminal law for over 20 years, and I have tried and won cases as both a federal prosecutor and criminal defense attorney. The defense needs its own story, and in my experience, the side that tells the simpler story at trial usually wins.

If the jury agrees, Trump would become a convicted felon, and could face up to four years in prison. But Trump’s defense attorneys will have much to say Tuesday about the evidence presented by prosecutors in an attempt to avoid that outcome. As to ledgers and invoices keeping track of these checks, Trump is the owner of the organization, not the bookkeeper or finance person. Cohen claims Trump was with the bodyguard at the time, and that he handed Trump the phone. The evidence shows that in order for checks to be issued to Cohen, Trump would have had to give his approval.

The witness, criminal defense lawyer Robert Costello, was sharply warned Monday afternoon by Judge Juan Merchan for glaring at the judge and muttering in disdain when Merchan upheld objections from prosecutors. "I'm putting you on notice that your conduct is contemptuous now," Merchan told Costello, after clearing the courtroom of most of the public and press when he had had enough of the former federal prosecutor's antics. "If you stare me down one more time, I will remove you from the stand," Merchan warned, according to a transcript of the verbal beatdown. How I see it, Cohen’s testimony only satisfied half the equation beyond a reasonable doubt. Weisselberg could be the linchpin to validate Cohen’s claims about Trump agreeing to reimburse him through Trump Organization, as a business expense. If so, there would have been no intent to falsify the business records.

CNN —Donald Trump will make his most concentrated effort yet to turn his criminal trial into a political asset in the next two days, heading from the courtroom to the campaign trail and back again. Not surprisingly, a majority of Democrats feel that Trump is being treated more leniently than others, while a majority of Republicans think the opposite. But there’s also a risk Trump’s loose tongue out on the trail could get him into trouble following his alleged violations of Merchan’s gag order. They were also tied in Pennsylvania, a third swing state Biden flipped from Trump four years ago. Trump is following a similar playbook as he fuses his criminal defense as a supposed victim of partisan persecution with his political offensive for a White House comeback.
