The Constitutional Court later overturned his medical parole, but Mr. Zuma then received a presidential pardon from his successor-turned-political rival, Mr. Ramaphosa. While he was granted a remission that reduced his time in prison, he had been sentenced to 15 months, which made him ineligible to run, the court decided. According to South African law, a person who has been convicted of an offense and sentenced to more than 12 months in prison cannot serve in the National Assembly. “It is declared that Mr. Zuma was convicted of an offense and sentenced to more than 12 months’ imprisonment,” Justice Leona Theron said. Mr. Zuma is not “eligible and not qualified” to stand for election until five years after the completion of his sentence, the justice added.

Johannesburg, South Africa CNN —South Africa’s apex court has ruled that former president Jacob Zuma is not eligible to run for parliament in next week’s critical general election. He was found guilty of contempt of court by the same constitutional court for his refusal to testify to an anti-corruption commission. It is that sentence that barred him from running, the court ruled on Monday. A contempt of court sentence is an extremely important sentence, and it is a sentence that cannot be treated lightly. While the court ruled that Zuma is not eligible to run for MP, his party will still contest the election and his face will remain on the ballot.

Opinion: Credibility is the key at Trump trial

The idea that Cohen talked to Trump about Daniels on that call “was a lie,” Blanche alleged. Moreover, my experience has been that juries don’t decide based upon one moment — they base their judgment on an overall view.”There were allegedly three parties aware of the scheme to conceal the real reason Trump paid Cohen more than $400,000 in supposed legal fees: Trump, Cohen and Allen Weisselberg, then-chief financial officer of the Trump Organization. “Weisselberg could be the linchpin to validate Cohen’s claims about Trump agreeing to reimburse him through Trump Organization, as a business expense,” wrote attorney Stacy Schneider. Trump seems to be tempted to go mano a mano and show that he is better fit to be commander-in-chief. The new requirement for GOP politicians wanting to demonstrate their loyalty to Trump seems to be visiting the Manhattan courthouse where he’s on trial.

The task before Judge Aileen Cannon, who is presiding over the classified documents case of Donald Trump, is not easy. She must protect Mr. Trump’s constitutional rights while also ensuring the prompt and fair administration of justice. Still, it is inexcusable that she is utterly failing to keep the case moving along in a fair but timely manner. And unfortunately, there isn’t much that the special counsel in the case, Jack Smith, can do about it. The volume of classified records subject to discovery is not outside the norm, and if the defendant were not Donald Trump, this would be a relatively routine Espionage Act prosecution for unlawful retention of classified records.

The US did a complete 180 on same-sex marriage
  + stars: | 2024-05-17 | by ( Zachary B. Wolf | ) edition.cnn.com   time to read: +8 min
The vast majority of Americans opposed same-sex marriage on May 17, 2004, when the first same-sex couples took their vows after a court decision in Massachusetts. Barack Obama notably opposed same-sex marriage when he ran for president as a Democrat in the 2008 election and, as public opinion was rapidly shifting, changed his tune in 2012 to support same-sex unions. Warnings were unfoundedThere is also evidence that warnings about same-sex marriage somehow endangering “traditional marriage” simply never materialized. A new study by researchers for the RAND Corporation to assess two decades of same-sex marriage in the US argues marriage rates actually increased among opposite-sex couples as same-sex couples were granted the ability to marry in certain states. A key difference between support for same-sex marriage and support for abortion rights, according to Lundry, is that support for abortion rights has remained positive for decades, in contrast to same-sex marriage, which saw a complete turnaround.

The Supreme Court rejected a challenge on Thursday to the way the Consumer Financial Protection Bureau is funded, one that could have hobbled the bureau and advanced a central goal of the conservative legal movement: limiting the power of independent agencies. The vote was 7 to 2, with Justice Clarence Thomas writing the majority opinion. “Under the appropriations clause,” he wrote, “an appropriation is simply a law that authorizes expenditures from a specified source of public money for designated purposes. The statute that provides the bureau’s funding meets these requirements. We therefore conclude that the bureau’s funding mechanism does not violate the appropriations clause.”

Blum turned to programs mostly in states where abortion access — and, by extension, abortion training — is likely to remain protected, like California, Colorado, and New Mexico. The AAMC analysis found the number of applicants to OB-GYN residency programs in abortion ban states dropped by 6.7%, compared with a 0.4% increase in states where abortion remains legal. For internal medicine, the drop observed in abortion ban states was over five times as much as in states where abortion is legal. The AAMC analysis notes that even in states with abortion bans, residency programs are filling their positions — mostly because there are more graduating medical students in the U.S. and abroad than there are residency slots. Stulberg and others worry that this self-selection away from states with abortion restrictions will exacerbate the shortages of physicians in rural and underserved areas.

The Consumer Financial Protection Bureau headquarters in Washington, D.C., on May 14, 2021. The Supreme Court ruled Thursday that the funding structure of the Consumer Financial Protection Bureau is legal. The court in a 7-2 decision rejected an argument that the CFPB's funding method violated the U.S. Constitution's Appropriations Clause because Congress had not annually authorized money for the agency. Instead, Congress authorized the CFPB to draw funding from the Federal Reserve system that the agency's director deems necessary for its work. The majority's ruling reversed a decision by the 5th Circuit U.S. Court of Appeals, which found the CFPB's funding mechanism was unconstitutional.

This was when I was a conservative constitutional litigator and occasional Republican Party activist, before my journalism career. Almost all of them showed Romney losing to Obama, and so conservative media started a movement to unskew the polls. There was even a website created, Unskewed Polls, that purported to fix the polling errors, and unskewed polls showed Romney winning. Conservatives believed that pollsters were deliberately undercounting Republican votes to discourage Republican voters and sway the results of the election. So to unskew the results, they reweighted the samples to include a higher percentage of likely Republican voters.

CNN —Robert F. Kennedy Jr.’s running mate, Nicole Shanahan, says their campaign supports federal limits restricting abortion access “between 15 and 18 weeks” of gestation, the latest statement on the issue after the campaign walked back recent comments made by Kennedy in opposition to government limits on abortion. “The campaign stance right now is very much, you know, looking at terms and limits, and the campaign very much supports limits on abortion,” she said. Kennedy said in a podcast interview released last week that he opposes any government limits on abortion access. In the new interview, Shanahan also expressed support for individual states deciding on abortion access, echoing Kennedy’s skepticism of the federal government regulating health care. But she said she’s concerned state-level abortion restrictions could make the issue “over-politicized.”“I think that the trend towards, you know, states making these decisions is good.

Congress created the bureau in 2010 to protect consumers from financial scams. The payday lending groups sued over a 2017 bureau rule that prohibited attempts to withdraw payments from accounts after two consecutive tries failed due to insufficient funds. Because of that, the conservative appeals court tossed the payday lending rule. The Biden administration appealed to the Supreme Court in 2022. CNN Supreme Court analyst Steve Vladeck said the ruling is another instance of the high court not endorsing controversial opinions from the 5th Circuit.

France declared a state of emergency on the Pacific island of New Caledonia on Wednesday after three young indigenous Kanak and a police official were killed in riots over electoral reform. The state of emergency, which entered into force at 5 a.m. local time (1800 GMT), gives authorities additional powers to ban gatherings and forbid people from moving around the French-ruled island. Police reinforcements adding 500 officers to the 1,800 usually present on the island, have been sent after rioters torched vehicles and businesses and looted stores. "No violence will be tolerated," said Prime Minister Gabriel Attal, adding that the state of emergency "will allow us to roll out massive means to restore order." He later signed a decree declaring a state of emergency that will last for 12 days and announced that French soldiers would be used to secure New Caledonia's main port and airport.

But while the former president has been uncharacteristically restrained recently, a cast of Republican lawmakers and Trump surrogates have traveled to court to rail about the proceedings. It's raised questions about whether the "surrogates" could be violating Trump's gag order. Sen. Tommy Tuberville of Alabama, who has been floated as a potential VP pick, told Newsmax one reason he attended was to "overcome this gag order." Under the gag order, Trump is not allowed to comment about Cohen. Nearly one in five voters in battleground states says that President Biden is responsible for ending the constitutional right to abortion, a new poll found, despite the fact that he supports abortion rights and that his opponent Donald J. Trump appointed three Supreme Court justices who made it possible to overturn Roe v. Wade. Trump supporters and voters with less education were most likely to attribute responsibility for abortion bans to Mr. Biden, but the misperception existed across demographic groups. Twelve percent of Democrats hold Mr. Biden responsible, according to New York Times/Siena College polls in Arizona, Georgia, Michigan, Nevada and Wisconsin and a Times/Philadelphia Inquirer/Siena poll in Pennsylvania. “I think the buck stops with him, so he had the ability to fight that, and that’s not what I’m hearing that he did,” said Terri Yonemura, 62, an abortion rights supporter in Las Vegas who said she would not vote for Mr. Trump, but is unsure about Mr. Biden, so may not vote at all.

The authorities in New Caledonia, a semiautonomous French territory in the South Pacific, put a curfew in place on Tuesday and banned all public gatherings after protests against a proposed constitutional change turned violent overnight. France’s High Commission of the Republic in New Caledonia announced on Tuesday that a “massive mobilization” of security and defense forces has been sent to quell the protests. In addition, a curfew was imposed in the capital, Noumea, for Tuesday night, and all public gatherings were banned along with the sale of alcohol and the transportation of weapons, the High Commission said. The latest protests started on Monday, before a scheduled Tuesday vote in the French Parliament on a change to New Caledonia’s Constitution that would expand French citizens’ eligibility to vote in provincial elections. Some pro-independence activists in the territory fear the amendment would water down their movement.
