CNN —The next time former President Donald Trump holds a campaign rally will be his first as a convicted felon. The 34-count guilty verdict reached Thursday by a Manhattan jury – the first criminal conviction of a former president – landed like a bomb on the American political landscape. Trump’s campaign had long braced for this outcome, readying their candidate and his supporters for an unfavorable conclusion by casting the case as a political spectacle. But now that a verdict has arrived, uncertainty lurks behind every decision. Trump and his lawyer, Todd Blanche, have indicated they will appeal, a process that could outlast the campaign itself.

At the heart of the criminal case against Trump was a payment prosecutors said was designed to influence the 2016 election. Trump repaid Cohen with a series of checks in 2017, once he was already president, prosecutors alleged. The verdict follows the first-ever criminal trial of a former American president. Washington CNN —Former President Donald Trump has uttered multiple false or misleading claims about his Manhattan criminal trial this week as the trial has neared a conclusion. An “advice of counsel” defense typically requires the defendant to waive attorney-client privilege. This Court can not endorse such a tactic.” Therefore, Merchan ruled, Trump could not invoke or even suggest a “presence of counsel” defense in the trial. Prosecutors provided three theories of what unlawful means Trump used. After Merchan refused last week to change his mind, Trump’s defense decided not to call Smith as a witness.

CNN —Donald Trump’s first criminal trial has arrived at its dramatic final act with lawyers for both sides primed on Tuesday to hammer home their cases before jurors consider a verdict that could make history. They argued during the trial that there was no evidence of criminal intent. The trial has not gripped the attention of the country as it might have were television cameras allowed in the courtroom. And Trump used his multiple criminal indictments to his political advantage in clearing the Republican nominating field. The time off only seems to have escalated Trump’s fury as one of the defining weeks of his life dawns.

Part of the reason for those modest hopes was the fact that the defense case would not include testimony by the defendant. Later, the charging conference to agree on jury instructions showed how daunting the law is that Trump faces. All of that is bad news not just for Costello, whose clash with Merchan won Trump’s praise outside the courtroom Monday, but also for the defense. Because Costello was one of Trump’s only witnesses, there is also the risk that he — and the jury’s reaction to his poor attitude — will taint the defense case overall. There was little the defense could do about the law in the charging conference beyond their usual able argument.

“The judge hates Donald Trump, just take a look, take a look at him, take a look at where he comes from. The intricate task that awaits jurorsIt’s impossible to know how jurors are interpreting the daily drama of the courtroom in any trial. Trump has denied the alleged affair with Daniels, and hush money payments are not illegal in themselves. When Cohen finally took the stand, he directly implicated Trump in the alleged scheme to buy Daniels’ silence. But he may have ended up creating a hole in the Trump defense, according to several legal experts.

Read previewLawyers in the Donald Trump hush-money trial spent Tuesday afternoon in a spirited battle over this question: what will the judge tell jurors right before they begin their deliberations next week? The jury charge is so important, so sacrosanct, that Merchan will order the doors to his courtroom sealed for its duration, with no one in the well or audience allowed to enter or leave. AdvertisementThe jury charge for this single felony should be easy, right? But it's not the only law jurors must understand and weigh when they begin deliberations as early as Wednesday. Or can some jurors find that Trump conspired to violate tax law, while other jurors see the falsification of National Enquirer business records as the central offense?

“It was Michael Cohen,” Davidson responded. Cohen is the only witness who will testify about Trump’s alleged involvement in both the decision to pay Daniels and the plan to reimburse Cohen for advancing the money. Prosecutors allege that during the February meeting, Trump and Cohen agreed how Cohen would be paid back. Arguably the most negative assessment of Cohen came from Davidson, who negotiated the hush money deal with Cohen on Daniels’ behalf in 2016. “There were times where Mr. Cohen did things that you felt were not helpful to what you were trying to accomplish, right?” Bove asked Trump’s 2016 campaign press secretary.

Those witnesses, longtime Trump Organization employees Jeffrey McConney and Deborah Tarassoff, handled the checks, invoices, and other records that comprise the 34 business records the Manhattan district attorney's office alleges Trump illegally falsified. He was sentenced to five months in jail in 2022 for a Trump Organization felony payroll tax-fraud prosecution, and is now serving another five-month sentence for felony perjury in last year's Trump Organization civil fraud trial. The Trump Organization needed to reimburse Cohen for some money, McConney testified that Weissberg told him. Yet another Trump Organization employee would FedEx the checks to Trump in DC, he testified. In the afternoon, prosecutor Christopher Conroy slogged through more records with Tarasoff, who said she has worked at the Trump Organization for 24 years.

Washington CNN —Former President Donald Trump continues to make false claims about his New York trial. Here’s a fact check of four false claims and one misleading claim he made about the trial in his courthouse comments last week. Judge Juan Merchan’s gag order, which narrowly restricts his out-of-court speech, does not in any way stop him from testifying. The gag order also does not broadly prevent Trump from talking. Defense tapes played in court Thursday have been posted to SoundCloud by Law360. They are recordings of 2018 phone calls between the two lawyers who struck the 2016 hush-money deal. They suggest an alternate reality to the DA's — where Trump is more victim than mastermind. Davidson's surmise — that Cohen was likely taping him at the time — makes a pair of newly-released defense tapes all the more compelling and perplexing. CNN —It’s a cliché to say that electricity surged through a courtroom — but it did when Hope Hicks took the stand Friday morning for her testimony in the election interference trial of former President Donald Trump. That is because as special counsel for the first Trump impeachment, I took her testimony on the alleged 2016 election influence scheme. When I took Hicks’ testimony for the impeachment proceedings, I found her to be a compelling witness, and the same was true Friday. Trump appeared to nod off repeatedly, including during Hicks’ testimony about how she first learned of the Daniels story. !” Asleep or awake, for Trump, Hicks’ testimony was a nightmare.

Norm Eisen Courtesy Norm EisenIn Donald Trump’s Manhattan election interference trial, the case is coming in better than expected, and that is ominous for the former president. The prosecution asked Davidson to explain the meaning of a text he had sent to Howard that evening. As the election was about to be called for Trump, Davidson sent a text to Howard asking, “What have we done?”Prosecutor Joshua Steinglass asked Davidson what the meaning of those words were. It also highlighted the stakes here: Unlike Trump’s 2020 election interference cases pending in Georgia and federal court, the unlawful effort to impact the election alleged in this case might have actually worked. I was watching the jury closely when Davidson spoke, and they were riveted.

CNN —Donald Trump will make his most concentrated effort yet to turn his criminal trial into a political asset in the next two days, heading from the courtroom to the campaign trail and back again. Not surprisingly, a majority of Democrats feel that Trump is being treated more leniently than others, while a majority of Republicans think the opposite. But there’s also a risk Trump’s loose tongue out on the trail could get him into trouble following his alleged violations of Merchan’s gag order. They were also tied in Pennsylvania, a third swing state Biden flipped from Trump four years ago. Trump is following a similar playbook as he fuses his criminal defense as a supposed victim of partisan persecution with his political offensive for a White House comeback.

Prosecutors have framed the trial as more than a simple case of falsifying business records — the offense with which Trump has been charged. But the results of Trump’s pending cases — and whether they even come to trial — could help decide the tone of a future presidency. But at the same time, Trump is using the privileges of appeals available to any defendant to their full extent. “We’re writing a rule for the ages.”It’s always hazardous to speculate how Supreme Court justices will rule based on their questioning in oral arguments. This could mean the case returns to lower courts for more litigation — a move that could delay the federal election trial for months, far beyond the November election.
