CNN —Special counsel David Weiss asked a California judge Wednesday to send indicted ex-FBI informant Alexander Smirnov back to jail while he awaits trial. A magistrate judge in Las Vegas released Smirnov on Tuesday, finding that even enough Smirnov posed a flight risk, he could be released under certain conditions. Those conditions include GPS monitoring, confiscating his two passports, and ordering him to remain in Nevada where he currently lives. Smirnov is charged with lying to the FBI about the Biden family’s dealings in Ukraine. In the court filings, Weiss said that Smirnov repeatedly lied to his FBI handler, whom he worked with for more than a decade, and should not be trusted.

A former Biden family business associate levied critical but unproven allegations against President Joe Biden in a closed-door House interview Tuesday, resurrecting claims he has lobbed since 2020. He further said he believed the multi-million-dollar business deals secured by Joe Biden’s son and brother only materialized “because Joe Biden was in high office.” He said, “the Biden family business was Joe Biden, period,” and specifically mentioned Joe Biden’s alleged role in a lucrative proposed deal with a Chinese energy conglomerate. “He had two encounters with President Biden in back-to-back days in May of 2017 that seemed extremely casual,” Raskin said. Despite providing information to the FBI, federal prosecutors haven’t cited his materials in the sweeping tax indictment filed against Hunter Biden. The Justice Department has accused Hunter Biden of tax evasion and other financial crimes over many years.

WASHINGTON (AP) — The U.S. House is ready to impeach Homeland Security Secretary Alejandro Mayorkas over border security, a deeply partisan and highly unusual attack on a Cabinet official that has drawn concerns from constitutional scholars and rebuke from Democrats. The House vote on the charges, which Democrats say are untrue and hardly grounds for impeachment, is set for Tuesday. “Very clearly Secretary Mayorkas has picked and chosen which laws he's going to enforce,” said Rep. Mark Green, R-Tenn., the chairman of the Committee on Homeland Security, at a hearing ahead of the vote. Green’s committee had been investigating the Homeland Security secretary for much of the past year, but a resolution from Rep. Marjorie Taylor Greene, R-Ga., a Trump ally, pushed it to the fore. Even if Republicans are able to impeach Mayorkas, he is not expected to be convicted in a Senate trial where Republican senators have been cool to the effort.

Some of the ire has been directed at House Oversight Chairman James Comer, who has spearheaded the investigation into Biden family business records. “I don’t think it goes anywhere,” one Republican lawmaker said of the Biden impeachment inquiry. One senior GOP impeachment inquiry aide said it would be “a win too in our eyes” if the probe ended with legislative proposals to reform federal ethics laws, regardless of the decision on impeachment. House Judiciary Chairman Jim Jordan, who is co-leading the investigation, acknowledged a Biden impeachment is not a forgone conclusion. “Nobody is talking about that,” said GOP Rep. Dan Newhouse of Washington state, when asked for his thoughts on the Biden impeachment inquiry.

WASHINGTON (AP) — James Biden will appear before House Republicans for a private interview next month as lawmakers seek to regain some momentum in their monthslong impeachment inquiry into his brother, President Joe Biden. James Biden's interview will take place just days before the president's son Hunter Biden will be deposed in private by the Republican-run committee, which has been investigating the Biden family's overseas finances for the past year. The committee found records of two loans that were made when Joe Biden was not in office or a candidate for president. In nearly every interview the witnesses have stated that they have seen no evidence that Joe Biden was directly involved in his son or brother's business ventures. House Republicans have shifted their focus, for now, on impeaching Homeland Security Secretary Alejandro Mayorkas over his handling of the situation at the U.S.-Mexico border.
