If you average the national polls since the debate 15 days ago, Trump’s ahead by 3 points. An NPR/PBS News/Marist College poll out Friday morning even put the race at 50% for Biden to 48% for Trump (a result within the margin of error). Biden was ahead by 9 points in the early July national polls in 2020. I think it’s totally fair to say that Trump is the favorite and that Biden has his work cut out for him. There is also data to suggest that Vice President Kamala Harris would be a stronger Democratic nominee against Trump than Biden.

(AP) — A judge has struck down an effort to enshrine reproductive rights, including abortion, in Nevada’s constitution, as abortion rights advocates in the western swing state attempt to follow other states in putting the question before voters in 2024. If allowed to proceed, Nevadans for Reproductive Rights would need just over 100,000 signatures to get the issue on the ballot. Abortion rights up to 24 weeks are already codified into Nevada law through a 1990 referendum vote, where two-thirds of voters were in favor. In Nevada, reproductive rights were central to Democratic campaigns in the 2022 midterms. Lawmakers in Nevada’s Democratic-controlled legislature are attempting to get reproductive rights including abortion access in front of voters on the 2026 ballot.

CNN —In a slew of court filings late Monday, attorneys for Donald Trump filed several motions asking the judge overseeing the election subversion case in Washington, DC, to dismiss the charges against the former president on grounds that, among other things, they violate his First Amendment rights and are the product of a “selective and vindictive prosecution.”“Countless millions believe, as President Trump consistently has and currently does, that fraud and irregularities pervaded the 2020 Presidential Election,” his attorneys wrote. Within the plethora of legal arguments as to why the charges against Trump should be dismissed, his attorneys also argued that the prosecution itself essentially amounts to a political hit job. “Three days after President Trump formally announced his candidacy, the Special Counsel was put in place as part of a flawed effort to insulate Biden and his supporters from scrutiny of their obvious and illegal bias,” his attorneys wrote, adding that the prosecution against Trump for actions he took while president show a selective prosecution from special counsel Jack Smith. Washington CNN —A Georgia indictment of former President Donald Trump for his efforts to overturn the 2020 election lists at least 27 lies Trump told about the election – and that’s counting conservatively. A federal indictment in early August, which also charged Trump for his efforts to subvert the will of the voters, listed 21 of his election lies. Trump’s lie that he was the real winner of the 2020 election. Trump’s lie that “about 4,502” people voted in Georgia even though they weren’t on the voter registration list. Trump’s lie that “as many as 2,560 felons with an uncompleted sentence” were permitted to vote in Georgia.

Several individuals involved in the voting systems breach in Coffee County are among those who may face charges in the sprawling criminal probe. They have gathered evidence indicating it was a top-down push by Trump’s team to access sensitive voting software, according to people familiar with the situation. That group included members of Sullivan Strickler, a firm hired by Trump’s attorneys to examine voting systems in the small, heavily Republican Georgia county, according to text messages obtained by CNN. Friess then notified operatives who carried out the Coffee County breach and others working directly with Giuliani that Trump’s team had secured written permission, the texts show. Coffee County was the only county in Georgia that failed to certify its election results due to issues raised by Hampton at the time.

In the classified documents case, Trump received a target letter from the special counsel’s office on May 19. Three days after that, on June 8, the grand jury returned an indictment against Trump and his co-defendant and aide Walt Nauta. Multiple sources told CNN that investigators have asked several witnesses before the grand jury and during interviews about the meeting, which happened about six weeks after Donald Trump lost the 2020 election. Some witnesses were asked about the meeting months ago, while several others have faced questions about it more recently, including Rudy Giuliani. Prosecutors have specifically inquired about three outside Trump advisers who participated in the meeting: former Trump lawyer Sidney Powell, one-time national security adviser Michael Flynn and former Overstock CEO Patrick Byrne, sources said. They also discussed naming Powell as special counsel to investigate supposed voter fraud, and Trump invoking martial law as part of his efforts to overturn the election.
