I was really rooting for TikTok. In 2020, when the Trump administration first tried to force TikTok’s Chinese owner, ByteDance, to sell the app or risk having it shut down, I argued that banning TikTok in the United States would do more harm than good. If the Chinese government wanted to snoop on Americans through their smartphones, it wouldn’t have to use TikTok to do it. It could buy troves of information from a data broker, thanks to America’s nonexistent federal data privacy laws. And I’m still worried that banning TikTok would be a huge gift to U.S. tech giants like Meta and Google, which own TikTok’s largest competitors — Facebook, Instagram and YouTube — further entrenching winners in a market that already has too little competition.

If enacted, the bill would give ByteDance 165 days, or a little more than five months, to sell TikTok. The legislation also has the support of the White House and House Speaker Mike Johnson. House lawmakers voted unanimously in the same session Thursday to advance a second bill, one that would limit US companies’ ability to sell Americans’ personal information to foreign adversaries. Speaking to reporters on the Capitol steps Thursday, Gallagher rejected characterizations of the bill as a TikTok ban. The TikTok account, with the handle "@bidenhq," debuted Sunday during Lunar New Year celebrations in China and Super Bowl 58 in the U.S. Biden campaign advisors told NBC News the TikTok account is part of an effort to meet voters where they are. The Biden White House has carried on a love-hate relationship with TikTok since Biden took office.

TikTok Music has launched on Wednesday in Australia, Singapore and Mexico to a small group of users. A federal judge in Montana has blocked a law that would have resulted in a state-wide ban of TikTok starting on Jan. 1, 2024. Before the judge's preliminary ruling, Montana was set to become the first U.S. state to ban the popular video and social media app, which is owned by the China-based tech giant ByteDance. ByteDance sued Montana in May to "prevent the state of Montana from unlawfully banning TikTok," the company said at the time. The lawmakers were concerned that the Chinese Communist Party may be able to access the data of U.S. citizens, and have considered implementing a nation-wide ban on TikTok.
