The lawmakers say they see an opening for compromise on an issue that has vexed Capitol Hill for decades, following last year’s bipartisan work to pass a gun-control law.

With a recession on the horizon, inflation remaining at decades-high levels, and rapidly climbing interest rates, the future of the real estate market heading into 2023 seems bleak. "I think the general theme of 2023 is going to be significant opportunities for people in real estate," Moore told Insider in a recent interview. A Fed pivot will also help stimulate the real estate market since the industry is highly sensitive to rates, boosting jobs in construction and lending. Finding emerging markets can be a goldmine for real estate investors, since these areas are oftentimes cheaper than their more established counterparts.

The proposal would require that workers be considered employees, entitled to more benefits and legal protections than contractors, when they are "economically dependent" on a company. Most federal and state labor laws only apply to a company's employees, who can cost employers up to 30% more than independent contractors, studies suggest. Federal law requires agencies to adequately explain their decision to withdraw and replace existing rules. The rule would treat companies as so-called "joint employers" under federal labor law when they have indirect control over working conditions such as scheduling, hiring and firing, and supervision. The 2020 rule barred NLRB staff from putting off elections while related cases alleging illegal labor practices are being litigated.

But now the states' motion sets the stage for a protracted legal battle that throws the future of the policy in doubt. A record number of migrants have been apprehended at the border since Biden took office in January 2021 and Republicans say ending Title 42 will draw even more crossers. After Sullivan's ruling, the Biden administration said it was making plans to manage the border without the order. The states said in their motion to intervene in the case that border states like Arizona and Texas would face "increased migrant flows" and that wherever migrants end up, "they will impose financial burdens on the states involuntarily hosting them." The states could also take the matter to the U.S. Supreme Court, where there is a majority of conservative justices.
