A Texas prosecutor said on Tuesday that he would seek to have a court overturn Gov. Greg Abbott’s pardon of a man convicted of fatally shooting a Black Lives Matter protester in Austin in the summer of 2020. The Republican governor’s pardon last month of the man, Daniel S. Perry, who had argued that he was acting in self-defense against an armed protester, was cheered by conservatives as a recognition of the state’s “stand your ground” protections. But it was also met with outrage by the protester’s family, civil rights groups and José Garza, the Travis County district attorney whose office had secured the conviction. On Tuesday, Mr. Garza, a Democrat, said he would petition the state’s highest criminal appeals court to overturn the pardon on the grounds that the governor had violated the constitutional separation of powers doctrine by intervening with a court’s actions.

CNN —A Texas appeals court upheld two injunctions in a pair of legal cases Friday, in an order blocking the state’s Department of Family and Protective Services from investigating families of transgender youth who are seeking gender-affirming medical care for their children. The court of appeals upheld a trial court decision in the Friday order, ruling in favor of LGBTQ+ advocates and families in two related Texas lawsuits asking a state court to block the agency from investigating parents who provide their children with gender-affirming care. Paxton appealed the district court injunction in March and declared investigations could continue during the appeal process under the law. The court, in its opinion, also affirmed Paxton’s opinion does not alter preexisting law or legal obligations of the department. Abbott’s directive to the agency was seen by many as an attack on transgender children and their families.

For many months, the small border city of Eagle Pass, Texas, has provided the backdrop for a bitter legal battle between Gov. Greg Abbott and the Biden administration over how best to handle record numbers of migrants arriving at the border. The court fights, which intensified this week, have centered on claims that the border is in crisis. McALLEN, Texas (AP) — Texas will build an operations base for up to 1,800 National Guard members in Eagle Pass, expanding the presence of soldiers in the border city where the state has clashed with the Biden administration over immigration enforcement, Republican Gov. “This will increase the ability for a larger number of Texas military department personnel in Eagle Pass to operate more effectively and more efficiently,” Abbott said. The mayor of Eagle Pass said the move at the start of January caught the city off guard and questioned the timing, given that crossings have fallen in recent weeks. The U.S. Justice Department last month asked the U.S. Supreme Court to order Texas to allow Border Patrol agents back into park.
